Hi,
I am just correcting your statement, distillation point referred here corresponds to ASTM D86 95% recovery to max 360 deg C.
There are effects of targeting this temperature lower or higher and are detailed in below links,

If you want to sell diesel it has to confirm to the applicable diesel specification. If that diesel spec states a maximum of 360 oC for 95% temperature but your diesel is 367 oC then you may not be able to sell it as diesel.
A higher 95% temperature will result in higher emission of soot in car exhaust.
